Day 275 — Despite Community Support and Assurances He Will Not Flee, Judge Denies Bond

Urgent Update

This morning, Elder had a bond hearing.  Evidence submitted to the court in Elder’s defense included over 50 letters from community members and faith leaders, family and friends, advocating for him to be released back home to await his immigration proceedings. In addition, about 20 of us were able to virtually attend the hearing to show the court and Elder our support for him.  Elder’s lawyer noted that he has never had a client with that amount of community support for a bond hearing.

Elder has spent 9 months in detention already. He has multiple pathways to status and is just a few months away from being able to receive his green card (progress is being made in the visa backups). Elder’s lawyer even offered up to a $50,000 bond. Elder was even willing to wear an ankle monitor.

Unfortunately, Elder’s time spent in detention so far, his willingness to go to an incredibly high bond amount, and our support was not enough.DHS was successful in their argument that Elder is a flight risk. 

Ultimately, the court denied Elder release on bond. He will remain in ICE detention for an unforeseeable amount of time while his immigration case waits.

Call Rep. Aderholt – and your own elected officials – and demand Elder be released.
